These Terms of Service govern the use of this website and the purchase of services from NBD Installs LLC. By visiting the site, submitting a contact form, calling the crew line or engaging us for a project, you agree to these terms. If you are acting for a company, you confirm that you have the authority to bind that company to these terms.
Please read this document before you schedule a survey. If you do not agree with any part of these terms, please do not use the site and do not engage our services. We are happy to answer questions about any section before you decide.
NBD Installs LLC, 2788 W 7180 S, West Jordan - 84084-2931, United States (US)
NBD Installs LLC is a fixture install crew that serves computer systems design and integration work. We set mount rigs, fit bracket packages, certify anchors, run load tests, prepare walls and walk punch lists. Our crew works from a yard in West Jordan, Utah and travels to client sites across the region.
We are not a general contractor and we do not provide structural engineering, electrical work, plumbing or any service that requires a separate license unless a licensed partner is engaged separately and named in the quote. The scope of each project is defined in the quote or the signed service sheet.
You must be at least eighteen years old to use this website and to engage our services. If you act on behalf of an organization, you represent that you are authorized to accept these terms and to approve the work that we will perform.
If the site where we will work is leased, you are responsible for confirming that the landlord or the property manager permits the installation. We can assist with documentation, but we cannot obtain that permission for you.
We provide six service lines: mount rig setup, bracket package fits, anchor certification days, load test rounds, wall prep sessions and punch list walks. These services are described on the services page and in the project quote. The description on the website is general, and the specific scope for your project is the scope set out in the quote or the signed service sheet.
We may decline a project if the site conditions are unsafe, if the substrate is unsuitable, if the device weight exceeds what the specified anchors can carry or if the work would require a license we do not hold. We will explain the reason in writing when we decline.
Each service run has a defined start and a defined deliverable. Mount rig setup ends when the rig is level, braced and ready for anchors. Bracket package fits end when the assembly has been dry fitted and the plate pattern is marked. Anchor certification days end when every stud on the schedule has been recorded. Load test rounds end when the sample has been pulled and the readings are logged. Wall prep sessions end when the bays are marked and the service loop is clear. Punch list walks end when the client signs the record. We use these gates to decide when a run is complete and when the next invoice is due.
Quotes are based on the information you provide and on a site survey where one is required. A quote is valid for thirty days unless it states otherwise. Survey dates and installation dates are estimates until they are confirmed in writing and, where we ask for it, secured by a deposit.
We will make reasonable efforts to keep the schedule. If weather, site access, supply delays or other events outside our control affect the schedule, we will notify you promptly and propose a new date. We are not responsible for delays caused by events outside our reasonable control.
If a survey reveals that the project needs more work than the initial quote assumed, we will not simply proceed. We will pause, explain the difference and issue a revised quote or a change order. You are never obligated to accept a revised number, and you may cancel the project at that point without paying for work that was not performed. We believe a clean stop is better than an unpleasant surprise on the final invoice.
You agree to provide safe and timely access to the work area, including parking, power, lighting and any building security procedures the crew must follow. If access is not available when the crew arrives, we may charge for the lost time as set out in the quote.
The crew surveys the substrate before installing. If the wall, ceiling or frame is not what the plans indicate, if the framing is not where the drawings place it or if the substrate is damaged, we will stop and report the condition. Additional work needed to correct a site condition is handled as a change order.
You agree to provide accurate device details, including weight, mounting pattern and required clearances. You agree to tell us about any concealed services within the work area, such as wiring, plumbing or fire suppression lines. If you do not know where those services run, you agree to arrange a scan before we start.
You also agree to keep people who are not involved in the project out of the active work area, to secure any valuable equipment in the room and to make the site manager available for the punch list walk. These obligations protect both your team and our crew.
If you manage the site for a landlord or a client, you agree to pass these obligations to the people who will actually be present during the work. If the site has a security desk, a badge process or a delivery window, you agree to share those details in time for the crew to plan around them. A crew that is turned away at the loading dock still costs the time it took to get there.
Fees are set out in the quote. Unless the quote states otherwise, we invoice after each service run or at the milestones named in the quote. Invoices are due within the period stated on the invoice. Late amounts may accrue interest at the rate stated on the invoice or the maximum rate permitted by law.
We may require a deposit before we hold a crew slot, especially for multi day projects or projects that require travel. Deposits are applied to the final invoice. If you cancel a confirmed date within the notice period stated in the quote, we may retain the deposit to cover the cost of the reserved crew time.
A change order is a written agreement to change the scope, the schedule or the price of a project. We will prepare a change order when you ask for additional work, when a site condition requires a different method or when the device schedule changes after the rig is assembled.
We do not begin work on a change until the change order is approved. This protects you from unexpected charges and it protects the crew from working without a defined scope.
Anchor certification records describe the substrate, the anchor family, the drill depth and the torque value for each stud, together with the pull test readings where a load test was part of the scope. We prepare the record carefully and we hand it to you at the punch list walk.
The record applies to the anchors we installed and tested. If a different crew modifies the rig, replaces a bracket or adds a device, the record no longer describes the assembly and you should not rely on it for the changed parts. We can return to inspect and recertify the changed work on a new service run.
We keep a copy of each certification sheet at the yard. If you lose your copy, you can ask us for a replacement, and we will send a duplicate of the record we hold. We cannot issue a certification for an anchor we did not set or test, and we cannot backdate a record. If a client needs a record for work that another crew performed, we can perform a fresh certification day and issue a new record that describes the assembly as we found it.
We warrant that our work will be performed in a professional manner and that anchors we certify will meet the rated values recorded on the certification sheet for the specified load and substrate. This warranty lasts for the period stated in the quote or, if no period is stated, for twelve months after the punch list walk.
The warranty does not cover damage caused by misuse, by a device that exceeds the specified weight, by a change made by another party, by movement of the building or by normal wear. If a covered defect appears, notify us promptly and we will inspect and correct it at no charge. This is your exclusive remedy for a warranty claim.
To the maximum extent permitted by law, NBD Installs LLC will not be liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost data, loss of use or damage to business, even if we were advised that such damages were possible.
Our total liability for any claim arising out of a project will not exceed the amount you paid us for the service run that gave rise to the claim. Nothing in these terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you. In that case the exclusions and limits apply to the fullest extent permitted by the law of your jurisdiction. If a limitation is found to be unenforceable, the remaining limits will remain in force.
You agree to indemnify and hold NBD Installs LLC and its crew harmless from claims, damages, losses and expenses, including reasonable legal fees, that arise from your breach of these terms, from inaccurate information you provide about the site or the devices, or from your failure to obtain a permission that the work required.
We agree to indemnify you against claims that arise from our own negligent performance of the work, subject to the limitation of liability in the previous section. This section survives the end of the project.
The content of this website, including the text, layout and the CSS drawn install rig, is owned by NBD Installs LLC or used with permission. You may view the site and print pages for your own reference, but you may not copy, republish or redistribute the content for commercial purposes without our written permission.
Certification sheets, survey notes and project documentation that we prepare for you are provided for the project. You may share them with your team, your building manager and your insurer. You may not present them as the work of another company.
You agree to use the website only for lawful purposes. You may not attempt to gain unauthorized access to the site or its server, introduce malicious code, interfere with other users, scrape the site at a volume that affects availability or use the contact form to send spam or unlawful content.
We may block access to the site if we believe that a user is abusing it. Blocking access does not affect any other right we may have under these terms or under law.
The contact form exists so that clients can reach the crew. If you use it to send an automated marketing message, a bulk offer or a message that has nothing to do with our services, we will delete it and may block the sending address. We would rather spend our inbox time on real survey requests than on filtering noise.
Our collection and use of personal information is described in the Privacy Policy, which is part of these terms. By accepting these terms you also acknowledge the Privacy Policy. If the two documents conflict on a privacy question, the Privacy Policy controls for that question.
We handle project information as described in the Privacy Policy. If you send us information about another person, you confirm that you have the right to share it and that the person understands it will be used for the project.
We may suspend or terminate a project if you do not pay an invoice when it is due, if the site becomes unsafe, if you ask us to perform work that is unlawful or if you breach these terms. We will give notice where it is practical to do so and we will allow a reasonable period to correct the issue.
If a project is terminated, you agree to pay for the work completed up to the termination date, including any materials that were ordered for the project and cannot be returned. Sections of these terms that by their nature should survive termination, such as payment, warranty, liability and indemnity, will continue to apply.
These terms are governed by the laws of the State of Utah, United States, without regard to conflict of law rules. We ask that you contact us first so that we can try to resolve any dispute informally. Most issues can be settled quickly with a phone call and a site visit.
If informal resolution does not work, the dispute will be resolved in the state or federal courts located in Utah, and each party consents to the jurisdiction of those courts. Each party waives any right to a jury trial to the extent permitted by law.
These terms, together with the quote and the Privacy Policy, are the entire agreement between you and NBD Installs LLC about the website and the services. If any provision is found to be unenforceable, the remaining provisions will continue in full force.
A failure to enforce a provision is not a waiver of that provision. You may not assign these terms without our written consent. We may update these terms from time to time by posting a revised version on this page, and the revised version will apply to future use of the site and to future projects.
If you have a question about these Terms of Service or about a project, please contact us. We are happy to walk through any section with you before you sign a quote.
